Clear terms for using Nova and purchasing Supernova access

Legal Framework

The terms governing your use of Nova and any purchase of Supernova access

1. Agreement to Terms

By installing or using Nova ("the Software"), or by purchasing Supernova access, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Software or purchase Supernova access.

These Terms apply to Nova, the Obsidian plugin created and maintained by Shawn Duggan ("we," "us," or "our").

2. Software License

Open Source License: Nova is released under the AGPL-3.0 license. You may use, modify, and distribute the software according to the terms of this license.

Core Features: Selection-based editing, chat commands, Auto-Context, Smart Fill, Writing Analysis, Writing Dashboard, and Prose Linter are free to use.

Supernova Features: Supernova unlocks Nova's premium features, beginning with Smart Revision. The specific set of premium features may evolve as the Software develops; these Terms do not promise any unannounced feature or release date.

3. Supernova One-Year Access

What You Receive: An active one-year licence unlocks the Supernova premium features available during the access period, beginning with Smart Revision. Nova's core editing, analysis, Prose Linter, Writing Dashboard, Smart Fill, and provider support remain free.

Price and Currency: The current price is US$29, charged once in United States dollars. The checkout page displays the amount you will be charged before payment.

Access Period: Access begins when the licence is issued and lasts 365 days. The licence key and activation instructions are delivered to the email address used at checkout shortly after successful payment.

No Automatic Renewal: This purchase is not a subscription and does not renew automatically. No cancellation is required. To continue using Supernova premium features after the access period, you must choose to make another one-year purchase.

AI Provider Costs: Supernova does not include hosted AI credits. You configure a supported local or cloud AI provider, and any charges from that provider are separate.

Existing Permanent Licences: Founding Supernova and Lifetime Supernova licences already sold remain permanent and do not expire.

Delivery Problems and Refunds: If a licence email is not delivered or a valid key cannot be activated because of a Nova fulfilment problem, contact hello@novawriter.ai so we can remedy the issue. Other refund requests are considered case by case. Nothing in these Terms limits any consumer right or remedy that cannot lawfully be excluded.

4. Acceptable Use

You agree not to use Nova for:

  • Any illegal activities or content that violates applicable laws
  • Generating spam, harmful content, or content that violates others' rights
  • Forging, reselling, publishing, or sharing a Supernova licence key
  • Commercial redistribution without complying with the AGPL-3.0 license
  • Any activity that could harm our infrastructure or other users

5. Privacy and Data

Nova Plugin: Nova collects no plugin telemetry, and we do not receive your documents, writing content, prompts, or AI responses.

AI Providers: If you configure a cloud AI provider, Nova sends the content needed for your request directly to that provider under its terms and privacy policy. A supported local provider can keep those requests on your device.

Local Storage: Nova settings, credentials, conversations, and licence data are stored locally. You are responsible for the security of your device, vault, credentials, and backups.

Website Services: The Nova website uses service providers for privacy-friendly analytics, checkout, licence-email delivery, and management of existing records from the paused newsletter. These website services are described in the Privacy Policy.

6. Disclaimers and Limitations

No Warranties: To the fullest extent permitted by law, Nova is provided "as is" without warranties, express or implied.

AI Content: Content generated by AI providers through Nova is not guaranteed to be accurate, appropriate, or suitable for any particular purpose.

Third-Party Services: Nova integrates with third-party AI services. We are not responsible for their availability, terms, or content.

Limitation of Liability: To the fullest extent permitted by law, our aggregate liability relating to Supernova is limited to the amount you paid for Supernova in the twelve months before the claim. Nothing in these Terms excludes liability or consumer protections that cannot lawfully be excluded.

7. Support

Documentation: Nova provides public installation and usage documentation on novawriter.ai.

Issue Reporting: Bugs and reproducible technical problems may be reported through the public GitHub issue tracker. Do not include private writing, credentials, licence keys, or other sensitive information.

No Service Level: Support is provided as available. We do not promise a particular response time, resolution, or feature request outcome.

8. Intellectual Property

Nova Brand: The Nova name, logo, and branding are our property and may not be used without permission.

Your Content: You retain full ownership of all content you create using Nova.

AGPL Compliance: Any modifications or derivatives of Nova must comply with AGPL-3.0 license terms.

9. Changes to Terms

We may update these Terms prospectively. Material changes will be identified on this page and may also be noted in Nova's release notes.

Changes will not shorten purchased access, convert a permanent licence into an expiring licence, or otherwise reduce rights already granted without the licence holder's agreement. The version accepted at checkout applies to that purchase unless the parties later agree otherwise or applicable law requires a different result.

10. Governing Law

These Terms are governed by the laws of Nova Scotia and the federal laws of Canada applicable there. Courts with jurisdiction in Nova Scotia will hear disputes, except where mandatory consumer law gives you the right to proceed elsewhere. Nothing in this section limits consumer protections that cannot lawfully be waived.
